When you bring your personal bankruptcy concerns to me, I will start by conducting a thorough review of your financial situation, so that I can determine whether bankruptcy is your best alternative. If there are no other viable options than bankruptcy, I will then help you identify whether you should file under Chapter 7 or Chapter 13.

Chapter 7 Bankruptcy

Under the recent changes to the federal bankruptcy law, you must qualify to seek protection under Chapter 7, which allows you to permanently discharge certain types of debt in exchange for the sale of non-exempt assets that you own. I will run the calculations to determine whether you qualify to file under Chapter 7. If you do, I will make certain that you understand which debts cannot be discharged under a Chapter 7 (student loan payments, child support arrearages, some tax obligations) so that you can make an informed decision as to whether this proceeding helps you accomplish your objectives.

Chapter 13 Bankruptcy

If you fail to qualify for protection under Chapter 7 or want to repay your creditors, I will help you reorganize your debt under Chapter 13. In this type of proceeding, you agree to repay your creditors over a 3 to 5 year period. In exchange, your creditors agree not to attempt to collect the debt by any other means. I will help you prepare a plan of reorganization and will review any proposals that come from your creditors, to ensure that they are within your means.
